1About Oh!Furwatch

Oh!Furwatch provides pet safety and tracking-related services through a combination of a compatible BLE device and the Oh!Furwatch mobile application.

The services may include features such as:

• Connecting and managing a compatible Oh!Furwatch device
• Viewing the last known or nearby location of a connected pet device
• Proximity and nearby device detection
• Safe zone management
• Community-assisted pet searching
• Pet profile management
• Vaccination and medical checkup records
• Pet weight management
• Subscription-based services and features

Oh!Furwatch is designed to assist pet owners in locating and recovering their pets. The service should not be considered a replacement for direct supervision, identification tags, microchipping, or other appropriate pet safety measures.

2Eligibility

You must provide accurate and complete information when creating an account or using our services. By using Oh!Furwatch, you confirm that:

• You are legally capable of entering into these Terms.
• The information you provide is accurate and up to date.
• You will use the services only for lawful purposes.
• You will not use another person's account without permission.
• If you are using Oh!Furwatch on behalf of another person, you confirm that you have the necessary authority to do so.

3Oh!Furwatch Account

An Oh!Furwatch account is required to access and use the Oh!Furwatch application and its features. You must create and maintain an account before using the services.

When creating an account, you are responsible for:

• Providing accurate and complete information.
• Keeping your account information up to date.
• Keeping your login credentials confidential.
• Maintaining the security of your account.
• Notifying us if you believe your account has been accessed without authorization.

You must not create an account using false information or use another person's account without permission.

You are responsible for activities carried out through your account unless the activity resulted from circumstances outside your reasonable control.

4Device and Application Requirements

Certain Oh!Furwatch features require a compatible Oh!Furwatch BLE device and a supported mobile device.

The functionality of the service may depend on:

• Bluetooth availability and signal strength.
• Your mobile device's hardware and operating system.
• Location services.
• Internet or network connectivity.
• Mobile device permissions.
• Environmental conditions and physical obstructions.
• The availability and proper functioning of the Oh!Furwatch service.

Bluetooth and location-based technologies have inherent limitations. The Oh!Furwatch device and application may not always provide an accurate or continuous location of your pet.

5Location and Tracking Limitations

Oh!Furwatch does not guarantee that the location displayed in the application represents the pet's current or exact physical location.

Location information may be affected by Bluetooth range, device positioning, environmental conditions, nearby devices, network availability, mobile operating system restrictions, and other technical factors.

You acknowledge that:

• Location information may be delayed or inaccurate.
• A device may become temporarily or permanently unreachable.
• The application may not detect a device outside its effective detection range.
• Safe zone alerts or other notifications may not always be delivered immediately.
• Community-assisted searching depends on the availability and participation of other compatible devices or users.

You remain responsible for taking reasonable steps to keep your pet safe.

6Community-Assisted Searching

Oh!Furwatch may provide features that allow users to assist in locating a missing pet.

Where applicable, information relating to a lost pet may be made available to other users or members of the community to assist with recovery.

You agree not to use this functionality to:

• Harass or threaten other users.
• Collect information about another person for unauthorized purposes.
• Impersonate another person.
• Submit false lost-pet reports.
• Use another person's information for unlawful purposes.

Oh!Furwatch does not guarantee that community-assisted searching will result in the recovery of a missing pet.

7Pet Information

You are responsible for ensuring that information you provide about your pet is accurate and up to date.

This may include:

• Pet name.
• Pet photo.
• Pet description.
• Owner contact information.
• Vaccination information.
• Medical checkup information.
• Weight information.
• Other information you choose to provide.

You should not enter sensitive information that is unnecessary for the use of the service.

Information provided through the Services may be collected, stored, processed and used by BAY in accordance with the Oh!Furwatch Privacy Policy.

8Subscription

Certain Oh!Furwatch features may require a paid subscription.

Available subscription periods, prices, and features will be displayed before you complete your purchase.

Subscriptions may be offered on a monthly, six-month, or twelve-month basis, depending on the subscription plans available at the time of purchase.

By purchasing a subscription, you agree to pay the applicable fees displayed at the time of purchase.

Subscription availability, renewal, cancellation, and refund arrangements may be subject to the payment platform, app store, or other applicable terms governing the transaction.

Information relating to your subscription and transaction may be collected and processed in accordance with the Oh!Furwatch Privacy Policy.

9Payments

Oh!Furwatch may use third-party payment providers to process payments.

Payment information may be processed by the applicable payment provider in accordance with its own terms and privacy practices.

Oh!Furwatch does not guarantee uninterrupted availability of any third-party payment service.

You agree to provide accurate payment and billing information where required.

Payment and transaction information may be collected and processed in accordance with the Oh!Furwatch Privacy Policy.

10Online Store and Product Purchases

Oh!Furwatch may offer physical products for purchase through its online storefront and third-party marketplaces.

Product prices, specifications, availability, delivery information, and applicable purchase terms will be presented at the time of purchase.

Orders may be subject to availability and confirmation.

Where purchases are made through third-party marketplaces, the terms, policies, payment processes, delivery arrangements, and return policies of the relevant marketplace may also apply.

Information relating to product purchases, orders, payments and delivery may be collected and processed in accordance with the Oh!Furwatch Privacy Policy.

11Refunds and Faulty Products

Unless otherwise required by applicable law, payments for Oh!Furwatch products, subscriptions and services are non-refundable.

If an Oh!Furwatch physical product is confirmed by BAY to have a manufacturing defect or product fault, BAY will provide a replacement in accordance with our applicable replacement or warranty process.

BAY may require proof of purchase and inspect or assess the product before approving a replacement.

Nothing in this section limits any consumer right, refund, replacement or other remedy that cannot legally be excluded under applicable law.

12Product Use and Safety

You are responsible for using the Oh!Furwatch device in accordance with the applicable product instructions.

You should regularly inspect the device and its attachment for signs of damage, wear, or improper fitting.

Do not use a damaged device or accessory if doing so may cause harm to your pet.

Oh!Furwatch products are intended to assist with pet safety and recovery and are not intended to replace appropriate supervision or other pet identification and safety measures.

13Acceptable Use

You agree not to:

• Use Oh!Furwatch for unlawful purposes.
• Attempt to gain unauthorized access to the application, systems, or accounts.
• Interfere with or disrupt the operation of the service.
• Reverse engineer, modify, or attempt to extract source code from the application except where permitted by applicable law.
• Upload malicious software or harmful content.
• Submit false or misleading information.
• Abuse the lost-pet or community-assisted searching features.
• Use the service to infringe another person's rights.
• Use automated systems to access the service without our permission.

We may suspend or restrict access where we reasonably believe that these Terms have been violated.

14Intellectual Property

The Oh!Furwatch application, website, software, designs, logos, trademarks, graphics, text, and other content are owned by or licensed to Byte Array Sdn. Bhd., unless otherwise stated.

You may use the application and services only for their intended purposes.

You must not reproduce, distribute, modify, sell, or commercially exploit Oh!Furwatch content without our prior written permission, except where permitted by applicable law.

15User Content

You may provide content through Oh!Furwatch, including pet photos, pet information, profile information, recovery-related information, and other content.

You retain ownership of content that you provide.

By submitting content to Oh!Furwatch, you grant us the permission necessary to store, process, display, and use that content to provide and operate the services.

You are responsible for ensuring that your submitted content does not violate applicable laws or the rights of another person.

Information contained in or relating to user-submitted content may be collected, stored, processed and used in accordance with the Oh!Furwatch Privacy Policy.

16Privacy

Your use of Oh!Furwatch is also subject to our Privacy Policy.

By using Oh!Furwatch, you acknowledge that your personal information may be processed as described in our Privacy Policy.

The Privacy Policy also explains the handling of account information, pet information, location information, device information, QR code information, user-submitted content, purchase and transaction information, subscription information, and other information collected through the Services.

If you terminate or request deletion of your account, the handling and deletion of your personal information will be subject to the account deletion and data retention provisions in our Privacy Policy.

17Third-Party Services

Oh!Furwatch may integrate with or rely on third-party services, including payment providers, app stores, online marketplaces, delivery and logistics providers, hosting providers, mapping or location services, and other technology providers.

We are not responsible for the availability, functionality, security, or policies of third-party services that are outside our control.

Your use of third-party services may also be subject to the third party's own terms and policies.

Where third-party services process personal information on behalf of BAY, the handling of such information is also subject to the applicable provisions of the Oh!Furwatch Privacy Policy.

18Service Availability

We aim to keep Oh!Furwatch available and operational, but we do not guarantee that the service will always be available, uninterrupted, secure, or error-free.

The service may be temporarily unavailable due to:

• Maintenance.
• System updates.
• Technical issues.
• Network problems.
• Third-party service failures.
• Events outside our reasonable control.

We may modify, suspend, or discontinue certain features or services where reasonably necessary.

19Disclaimer

Oh!Furwatch is intended to provide assistance with pet safety and recovery.

To the extent permitted by applicable law, we do not guarantee that:

• Your pet will always be detected or located.
• The location information will always be accurate.
• A lost pet will be recovered.
• Notifications will always be delivered.
• The device will always remain connected to the application.
• The service will always operate without interruption.

You acknowledge that technology-based location and proximity services have inherent limitations.

20Limitation of Liability

To the maximum extent permitted by applicable law, Byte Array Sdn. Bhd. shall not be liable for any indirect, incidental, special, consequential, exemplary or similar losses, damages, costs or expenses arising out of or relating to your access to, use of, or inability to use the Oh!Furwatch Services, devices, products or related services.

To the maximum extent permitted by applicable law, BAY shall also not be liable for any loss, damage, injury, death, loss of pet, loss of property, loss of data, loss of business, loss of profits, loss of opportunity or other loss arising from or relating to:

• misuse, improper use, unauthorized modification or alteration of an Oh!Furwatch device or product;
• failure to follow product instructions, safety instructions or other guidance provided by BAY;
• use of the product in a manner for which it was not designed or intended;
• failure to properly install, attach, maintain or use an Oh!Furwatch device or product;
• use of the Services or product together with third-party products, accessories, applications, devices or services;
• circumstances outside BAY's reasonable control;
• inaccurate, incomplete, delayed or unavailable location information;
• limitations of Bluetooth, mobile networks, GPS, mapping services or other technologies;
• reliance on the Oh!Furwatch Services as the sole method of locating, monitoring or recovering a pet; or
• any other circumstances where the loss, damage, injury or death was not directly caused by a defect or breach attributable to BAY.

Oh!Furwatch is intended to assist with pet monitoring and recovery and is not a substitute for reasonable supervision, physical identification, microchipping or other appropriate measures to protect and recover a pet.

You acknowledge that location, proximity, Bluetooth, mapping and recovery features may be affected by environmental conditions, device limitations, connectivity, battery level, interference and other technical factors. BAY does not guarantee that an Oh!Furwatch device or the Services will always detect, locate, monitor or recover a pet.

Nothing in these Terms excludes or limits any liability, obligation, consumer right, warranty, guarantee or remedy that cannot legally be excluded or limited under applicable law.

Nothing in these Terms is intended to exclude or limit liability arising from fraud, wilful misconduct, or any other matter for which liability cannot legally be excluded or limited.

Where applicable law imposes liability on BAY notwithstanding these Terms, BAY's liability shall be limited to the maximum extent permitted by applicable law.

21Indemnity

To the extent permitted by applicable law, you agree to indemnify and hold Byte Array Sdn. Bhd. harmless from claims, losses, liabilities, damages, costs, and expenses arising from your misuse of the Oh!Furwatch services, violation of these Terms, or violation of another person's rights.

22Suspension and Termination

We may suspend or terminate your access to Oh!Furwatch if:

• You materially breach these Terms.
• You use the service for unlawful or fraudulent purposes.
• Your use creates a security or operational risk.
• Suspension or termination is required by law.

You may stop using the Oh!Furwatch services at any time.

You may also request deletion of your account in accordance with the account deletion process described in our Privacy Policy.

Termination of an account does not necessarily remove information that we are required or permitted to retain under applicable law or our Privacy Policy.

23Changes to These Terms

We may update these Terms from time to time.

When we make changes, we may update the “Last Updated” date and, where appropriate, provide additional notice through the application, website, or other reasonable means.

Your continued use of Oh!Furwatch after the updated Terms become effective constitutes your acceptance of the updated Terms.

24Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of Malaysia.

Any dispute arising from or relating to these Terms shall be subject to the applicable courts and laws of Malaysia.
